1. Overview & acceptance

These Terms of Service (the "Terms") govern your access to and use of the website at arfaconsults.com (the "Site") and any services offered through it by ARFA, Applied Resources for Facility Automation, operated by Arfa McClain in Lawrenceville, Georgia ("ARFA," "we," "us"). By using the Site you agree to these Terms.

Two different sets of relationships. These Terms govern your use of arfaconsults.com. If you are a patient interacting with a healthcare practice that uses an ARFA-built workflow (voice agent, missed-call recovery, etc.), your relationship is with that practice, not directly with ARFA. The practice's own terms govern that interaction. ARFA acts as a HIPAA Business Associate to the practice and not as your direct service provider.

2. Use of the Site

You may use the Site for the purpose of learning about ARFA's services, contacting ARFA, and submitting requests for workflow leak reviews or demos. You may not:

3. ARFA services

ARFA provides custom-built operational automation services to independent healthcare practices, including but not limited to: voice receptionist services, missed-call recovery, dashboard categorization, EHR / scheduling synchronization, and related operational workflows. These services are delivered under a separate written engagement agreement and Business Associate Agreement between ARFA and each practice. These Terms do not constitute or modify any such engagement agreement.

ARFA does not provide medical advice, clinical decision support, diagnostic services, or any service that constitutes the practice of medicine. All clinical decisions remain the responsibility of the licensed practitioners at the practice.

4. SMS communications

If you provide your phone number to ARFA, either directly through the Site or through a workflow ARFA operates on behalf of a healthcare practice, you may receive SMS messages from that practice's ARFA-operated workflow.

Messages may include appointment confirmations, missed-call recovery messages, appointment reminders, refill status updates, and related operational communications. Message frequency varies and depends on your relationship with the practice; a typical patient relationship results in 2-4 messages per month.

By providing your phone number, you consent to receive such messages. Message and data rates may apply. Reply STOP at any time to unsubscribe; you will receive one confirmation message and no further SMS messages will be sent. Reply HELP at any time to receive contact information for support.

ARFA does not use SMS for marketing or promotional content unrelated to the practice's services. ARFA does not send SMS messages on behalf of any third party other than the practice you contacted. See our Privacy Policy SMS section for additional details.

5. Intellectual property

The Site, including its design, text, images, logos, and code, is owned by ARFA and protected by copyright, trademark, and other intellectual property laws. The ARFA name and logo are trademarks of ARFA. You may not copy, modify, distribute, sell, or lease any part of the Site or its content without ARFA's prior written permission, except for personal, non-commercial use of publicly accessible content.

The Site and any content provided through it are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. ARFA does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Any estimates, benchmarks, or projections shown on the Site (including but not limited to revenue-leak estimates, call-volume statistics, or workflow timing claims) are illustrative. Actual results vary by practice and depend on factors outside ARFA's control. Nothing on the Site constitutes a guarantee of any specific outcome.

Information on the Site is not medical, legal, or financial advice.

8. Limitation of liability

To the maximum extent permitted by law, in no event shall ARFA or Arfa McClain be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, arising out of or in connection with your use of the Site, even if ARFA has been advised of the possibility of such damages.

ARFA's total cumulative liability arising out of or related to your use of the Site shall not exceed one hundred U.S. dollars ($100.00). For ARFA's services delivered under a separate engagement agreement with a practice, liability is governed by that engagement agreement and its associated Business Associate Agreement, not by these Terms.

9. Indemnification

You agree to indemnify, defend, and hold harmless ARFA, Arfa McClain, and their affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site in violation of these Terms, (b) your violation of any law or third-party right, or (c) any content you submit through the Site that infringes the rights of any third party.

10. Termination

ARFA may suspend or terminate your access to the Site at any time, with or without notice, for any conduct that ARFA reasonably believes violates these Terms or applicable law. The provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive.

11. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to the personal jurisdiction and venue of those courts.

12. Changes to these terms

ARFA may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will provide reasonable notice (such as a banner on the Site) before the change takes effect. Continued use of the Site after notice constitutes acceptance of the updated Terms.
